Canada’s Historic Recreational Nationwide Cannabis Legislation

In Canada, they passed the Cannabis Act on October 17th, 2018, which allows for recreational use of cannabis products to adults over the age of 18. The act has three main principles which help regulate the implementation of the change: 

  • The first goal is to keep cannabis out of the hands of youth. 
  • The second goal is to keep profits out of the pockets of criminals. 
  • The third goal is to protect public health and safety by allowing adults access to legal cannabis. 

Marijuana Laws in the United States

In the United States, regulation of the laws of cannabis use is up to the discretion of each state and territory. Thirty-six states and four territories have legalized the use of cannabis for medical purposes as of May 18th, 2021

Mississippi’s voters approved the medical use of marijuana in November 2020, but the state supreme court overturned it on May 14, 2021. Twenty-eight states, two territories, and the District of Columbia have enacted legislation to regulate cannabis for nonmedical purposes as of November 29, 2021. The new legislation brings the total number of states that have regulated nonmedical cannabis to eighteen, plus two territories and the District of Columbia. 

There are 36 states, the District of Columbia, Guam, Puerto Rico, and the US Virgin Islands, with public medical marijuana/cannabis programs. Eleven states have approved measures allowing the use of “low-tetrahydrocannabinol (THC), high-cannabidiol (CBD)” products for medical reasons in limited circumstances or as a legal defence. At the federal level, cannabis is still considered a felony offence, but the Department of Justice has previously stated that it will defer to the state to enforce its own laws.
